This User Agreement, and all of its terms and conditions, constitute a legal
contract between you and Car Audio Deals (References to "you" or "your"
shall relate to a customer of Car Audio Deals or other party that visits, browses,
shops, accesses or otherwise uses the Site (the "Customer"); references
to "Car Audio Deals" shall relate to Car Audio Deals and its affiliates.)
By visiting, browsing, shopping, accessing or otherwise using this site ("Site"),
you acknowledge that you have read, understood, and agree to be bound by this
User Agreement and comply with all applicable laws and regulations, including
U.S. export and re-export control laws and regulations. If you do not agree
to this User Agreement, as it may be changed by Car Audio Deals from time to time,
do not use this Site. The material provided on this Site is protected by law,
including, but not limited to, United States copyright law and international
treaties. This Site is controlled and operated by Car Audio Deals from its offices
within the United States. Car Audio Deals makes no representation that materials
in the Site are appropriate or available for use in other locations, and access
to them from territories where their contents are illegal is not authorized.
Those who choose to access this Site from other locations do so on their own
initiative and are responsible for compliance with applicable local laws.
Any claim relating to, and the use of, this Site and the materials contained
herein is governed by the laws of the state of Rhode Island without regard to conflict
of law rules. You consent to jurisdiction of the federal and state courts located
in Rhode Island to hear any such claims.
Access, Interference and Linking
Car Audio Deals grants you a limited license to access and make personal use of
the Site and not to download (other than page caching) or modify it, or any
portion of it, except as provided below under "Use Restrictions,"
or with express written consent of Car Audio Deals.

Arbitration

AGREEMENT, WILL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION under
the Code of Procedure of ARBITRATION-FORUM.COM (the "Code") in effect
at the time the claim is filed. The Code is available at http://www.arbitration-forum.com
or can be obtained by calling 1-800-753-9448. Notwithstanding any choice of
law provision included in this User Agreement, this arbitration agreement is
subject to the Federal Arbitration Act (9 U.S.C. §§ 1-16) and the
New York Convention on the Enforcement of Arbitration Awards (9 U.S.C. §§
201-208 or as codified in the jurisdiction where enforcement of the award is
sought). Hearings shall be held as provided by the Code and if any In-person
Hearing is required, it shall be held in Rhode Island. Each party shall bear
its own cost of any legal representation, discovery, or research required to
complete arbitration.
Privacy

You are responsible for maintaining the confidentiality of your account and
password and for restricting access to your computer, and you agree to accept

PLEASE READ THESE TERMS AND CONDITIONS OF SALE ("SALE AGREEMENT")
VERY CAREFULLY.
THE CUSTOMER AGREES TO BE BOUND BY THIS SALE AGREEMENT AND ACCEPTS ITS TERMS
AND CONDITIONS (UNLESS THE CUSTOMER HAS SIGNED A SEPARATE FORMAL PURCHASE AGREEMENT
WITH Car Audio Deals. IN WHICH CASE THE SEPARATE AGREEMENT SHALL GOVERN).
Important Information About This Legal Contract
This Sale Agreement is a legal contract between the Customer and Car Audio Deals.
The Customer accepts this Sale Agreement by making a purchase, placing an order,
or otherwise shopping on the Site. (References to "you" or "your"
shall relate to the Customer; references to "Car Audio Deals" shall
relate to Car Audio Deals and its affiliates.) The terms and conditions of this
Sale Agreement are subject to change without prior notice, except that the terms
and conditions posted on the Site at the time the Customer initially places
or modifies an order will govern the order in question.
This Sale Agreement constitutes the entire agreement between the Customer and
Car Audio Deals relating to the purchase or sale of goods or services on the Site.
The Sale Agreement may only be modified or terminated with regard to goods or
services that have been purchased or sold on the Site in a writing signed by
Car Audio Deals. Electronic records (including signatures), that are otherwise
valid, shall be accepted under the Sale Agreement. The Customer consents to
receiving electronic records, which may be provided via a web browser or e-mail
application connected to the Internet; consumers may withdraw consent to receiving
electronic records or have the record provided in non-electronic form by contacting
Car Audio Deals at the address provided below.
In the event of any conflict between the terms and conditions stated on your
purchase order and this Sale Agreement or any terms and conditions on our invoice,
you agree that the provisions of this Sale Agreement and our invoice shall control.
Governing Law
THIS AGREEMENT AND ANY SALES HEREUNDER SHALL BE
GOVERNED BY THE LAWS OF THE STATE OF Rhode Island, WITHOUT REGARD TO CONFLICTS OF
LAWS RULES. THE CUSTOMER CONSENTS TO THE JURISDICTION OF THE FEDERAL OR STATE
COURTS LOCATED IN Rhode Island FOR PURPOSES OF ANY SUIT, ACTION
OR PROCEEDING ARISING OUT OF THIS SALE AGREEMENT.
Title; Risk of Loss
Title to goods herein being purchased is retained by the seller until goods
are paid for by the purchaser and at that time title passes to the purchaser.
Loss or damage that occurs during shipping by a carrier selected by Car Audio Deals
is Car Audio Deals's responsibility. Loss or damage that occurs during shipping
by a carrier selected by Customer is Customer's responsibility. Title to software
will remain with the applicable licensor(s).
Export Sales
If goods herein being purchased are being purchased for purposes of export,
the Customer must obtain from the federal government certain export documentation
before shipping to a foreign country. In addition, manufacturers' warranties
for exported goods may vary or even be null and void for goods exported outside
the United States. The Customer should inquire further regarding any questions.
Any and all liability is only for the products purchased.
General Legal Disclaimer
Car Audio Deals HEREBY EXPRESSLY DISCLAIMS ALL WARRANTIES EITHER EXPRESSED OR
IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY OR FITNESS
FOR A PARTICULAR PURPOSE. THIS DISCLAIMER BY Car Audio Deals IN NO WAY AFFECTS
THE TERMS OF THE MANUFACTURER'S WARRANTY, IF ANY.

56K Disclaimer
56K modems are capable of 56Kbps downloads, however, current regulations limit
download speed to 53Kbps.
Third-Party Product and Y2K Disclaimer
All products sold by Car Audio Deals are third party products and are subject
to the warranties and representations of the applicable manufacturers, including
but not limited to Y2K compliance. Accordingly, Car Audio Deals makes no representation
or warranty with respect to the Y2K compliance of products sold.
Pricing and Information Disclaimer
All pricing subject to change. For all prices, products and offers, Car Audio Deals
reserves the right to make adjustments due to changing market conditions, product
discontinuation, manufacturer price changes, errors in advertisements and other
extenuating circumstances. High volume bids are welcome!
While Car Audio Deals uses reasonable efforts to include accurate and up-to-date
information on the Site, Car Audio Deals makes no warranties or representations
as to the Site's accuracy. Car Audio Deals assumes no liability or responsibility
for any errors or omissions in the content on the Site.
Limitation of Liability

AGREES THAT FOR ANY LIABILITY RELATED TO THE PURCHASE OF PRODUCTS OR SERVICES,
Car Audio Deals IS NOT LIABLE OR RESPONSIBLE FOR ANY AMOUNT OF DAMAGES ABOVE THE
AGGREGATE DOLLAR AMOUNT PAID BY CUSTOMER FOR THE PURCHASE(S) UNDER THIS AGREEMENT.
Arbitration
ANY CLAIM, DISPUTE, OR CONTROVERSY (WHETHER IN CONTRACT, TORT, OR OTHERWISE,
WHETHER PREEXISTING, PRESENT OR FUTURE, AND INCLUDING STATUTORY, COMMON LAW,
INTENTIONAL TORT AND EQUITABLE CLAIMS) arising from or relating to this Sale
Agreement, its interpretation, or the breach, termination or validity thereof,
the relationships which result from this Sale Agreement (including, to the full
extent permitted by applicable law, relationships with third parties who are
not signatories to this Sale Agreement), Car Audio Deals's advertising, or any
related purchase SHALL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION
ADMINISTERED BY THE NATIONAL ARBITRATION FORUM (NAF) under the Code of Procedure
of ARBITRATION-FORUM.COM (the "Code") in effect at the time the claim
is filed. The Code is available at http://www.arbitration-forum.com or can be
obtained by calling 1-800-753-9448. Notwithstanding any choice of law provision
included in this Sale Agreement, this arbitration agreement is subject to the
Federal Arbitration Act (9 U.S.C. §§ 1-16) and the New York Convention
on the Enforcement of Arbitration Awards (9 U.S.C. §§ 201-208 or as
codified in the jurisdiction where enforcement of the award is sought). Hearings

Orders; Payment Terms; Interest; Taxes
Orders are not binding upon Car Audio Deals until accepted by Car Audio Deals. Terms
of payment are within Car Audio Deals's sole discretion. Invoices are due and
payable within the time period noted on the invoice, measured from the date
of the invoice. Car Audio Deals may invoice parts of an order separately. Customer
agrees to pay interest on all past-due sums at the highest rate allowed by law.
The Customer is responsible for sales and all other taxes associated with the
order.
Freight Policy
Shipping and handling charges on all orders vary. For the Customer's
protection, we ship only to the verified billing
address of the Customer's credit card. For items paid with Paypal we Car Audio Deals can ship only to the address listed in the Paypal payment.
Car Audio Deals ships only to street addresses in the US 48 states.
Shipping to non US locations is not supported. Shipping to PO BOX's is not supported. Shipping to APO/FPO
addresses is not supported. Shipping to AK, HI, PR, GU, AS and all US territories is not suported.
Telephone Number Policy The customers account must contain a valid, working telephone number when an order is placed. If a credit card is used for payment, Car Audio Deals reserves the right to contact the cardholders bank to verify the telephone number provided by the customer matches the telephone number on file with the cardholders bank. If the cardholders bank is unable to verify the telephone number as a match then Car Audio Deals reserves the right to delay final shipping until such time that a telephone number is provided that does match the telephone number on file with the cardholders bank. If no such telephone number is provided, Car Audio Deals reserves the right to cancel the associated order and refund the payment minus applicable transaction processing fees (which are generally between 3% and 5% of the complete payment total).
Transit Time Policy
Multiple transit time selections are available for selection during customer checkout.
These selections include, but are not limited to, 1 Business Day, 2 Business Day, 3 Business Day, and
Economy (up to 5 Business Day). These represent a transit time guarantee of service, meaning that once
an order has been shipped the order will have a delivery attempt made after the number of business days have
elapsed that are listed with the service. For example, if 1 Business Day service is selected and the order is
shipped on a Tuesday, then a delivery attempt will be made on the next day, Wednesday (assuming that that
particular Wednesday is a business day). Note the transit times are figured from when an order is shipped, not
when an order is placed. Car Audio Deals does its best to have all orders shipped within 1 business day
of an order being placed, however there is no guarantee written or implied that only 1 business day will elapse between
an order being placed and then subsequently shipped. Note that the actual shipping service used to implement the transit
time guarantee is at the sole discretion of Car Audio Deals. If a delivery attempt is not made on
the day guaranteed, then a refund request in the amount of the difference between the level selected and the actual
delivery attempt date can be requested in writing by the customer and mailed to
Car Audio Deals, PO BOX 227, Peace Dale, RI 02883.
Fraudulent Chargeback Policy
If you place a chargeback with your credit card company (on purpose or by mistake)
for an order that you placed and received without attempting to resolve the issue with us first, there will
be a $50.00 research fee charged to your account upon reversal of the chargeback by our merchant provider
to cover our investigative expenses to prove that you did make the purchase, that you did receive it and
that you failed to resolve the dispute with our company first.
Wholesale Accounts
Car Audio Deals may at it's discretion grant access to special pricing levels ("Wholesale Pricing") through the use of wholesale accounts. Determination for access to these pricing levels is determined by Car Audio Deals, and may be suspended at their discretion. These wholesale accounts are for the sole use of the clients granted access, and are not to be transfered in anyway. Unauthorized use of a wholesale account will lead to suspension of said account. Payment options for these wholesale accounts are restricted to money orders, cashiers checks, and bank transfers. Other payment options must be negotiated and approved by Car Audio Deals.
Return Policy
The following refund policy applies
to all products except those stating their own refund policy with the product
description:
Please e-mail our Returns Department
at sales@caraudiodeals.com to obtain a Return Merchandise Authorization (RMA) number
before shipping your product. NO returns of any type will be accepted without
an RMA number. For faster service, please have the following information on
hand when asking for an RMA number: customer name, invoice number, serial
number and nature of the problem. All returns processing is done via email only.
All products returned MUST: be 100 percent complete,
contain ALL original boxes and packing materials, have original UPC codes
on the manufacturer boxes, contain all manuals, blank warranty cards and other
accessories and documentation provided by the manufacturer. Incomplete returns will
be subject to replacement charges on missing items.
You are responsible for shipping charges on
returned items; and on your replacement or exchange item(s).
Car Audio Deals strongly recommends you fully
insure your return shipment in case it is lost or damaged and you use a carrier
that can provide you with proof of delivery for your protection.
If merchandise arrives damaged: it is best to
REFUSE it back to the carrier attempting delivery. If you accept the package
make sure it is noted on the carrier's delivery record in order for Car Audio Deals
to file a damage claim. Save the merchandise AND the original box and packing
it arrived in, notify Car Audio Deals immediately to arrange for a carrier inspection
and a pick up of damaged merchandise. If you do not notify Car Audio Deals of
damaged goods within the first 15 days of arrival, our regular return policy
will override any claim of damage, and will fall under all current manufacturer
restrictions. Contact Car Audio Deals to arrange
for carrier inspection and a pick up of damaged merchandise.
Authorized returns will be processed for credit or replacement or exchange or repair at the discretion of Car Audio Deals.
Returns are subject to a 20 percent restocking fee
Manufacturer warranty restrictions do apply. Any item that is missing the UPC can ONLY be replaced
with the same item.
Returns received after 60 days from the date of purchase are eligible for credit towards future purchases only.
Protection Plan Terms
- The term of this contract and coverage under this contract begins upon the date of purchase.
- Each Protection Plan covers one piece of mobile electronics equipment.
- If the product covered under this contract is found to be defective, CarAudioDeals.com will repair, replace, or refund at our discretion. Refund will be the original merchandise cost at time of purchase excluding shipping, handling, taxes and the cost of purchasing this protection plan contract, which are all non-refundable.
- To be found defective, the product must fail during normal usage. The limit of liability under this contract is original merchandise cost at time of purchase excluding shipping, handling, taxes and the cost of purchasing this protection plan contract, which are all non-refundable.
- If a defective product is replaced with a new item under the terms of your Protection Plan, your plan expires. You will then have the option of purchasing a new Protection Plan for the replacement equipment.
- We DO NOT COVER: Damage, warping or rusting of any kind to the housing, case or frame of the product or to any non-operating part, including any or all plastic, wood or decorative parts; repair or replacement of parts normally designed to be replaced periodically by the Purchaser during the life of the product; loss or damage resulting from external causes such as but not limited to, damage resulting from a collision with any object, or from fire, flooding, sand, dirt, an Act of God, insect infestation, or damage from exposure to weather conditions or battery leakage, theft, misuse, abuse, damage resulting from failure of, or improper use of any electrical source, or connection to other products not recommended for interconnection by the manufacturer of the product covered under this contract; add-on items, accessories or attachments, external wiring and cabling, battery chargers, structural items, racks, bins, knobs, handles, appearance items, antennas, jacks, consumables, loss or damage resulting from the failure to provide manufacturer's recommended maintenance.
- Purchase cost of this plan is non-refundable.
- We DO NOT reimburse for: shipping, handling, packaging, transporting, time, labor, or anything associated with this such as but not limited to, installation, removal, reinstallation, being without vehicle use, bringing the item to a shipping center or preparing item for shipping.
- This is a one-time use contract only. Once the Replacement/Repair/Refund has been issued, this contract is terminated.
WHAT TO DO WHEN A PRODUCT FAILS TO OPERATE:
Do not return the product until you have a Return Authorization Number (RA#). Email us to obtain a RA# and any additional instructions that may be needed. Purchaser must package the item carefully and ship it to the following address:

Car Audio Deals does not accept personal checks or business checks.
Stop Payment Policy
Car Audio Deals charges a $25 fee for payments that are stopped or are returned as not cleared.
